Summary of the House Committee Version of the Bill

SB 368 -- TRAFFIC CONTROL SIGNALS

SPONSOR:  Stouffer (Jones, 117)

COMMITTEE ACTION:  Voted "do pass" by the Committee on Crime
Prevention by a vote of 10 to 0.

This bill creates an affirmative defense for a motorcycle rider
who enters or crosses an intersection controlled by a traffic
signal against a red light if the motorcycle has been brought to
a complete stop, the traffic signal shows a red light for an
unreasonable time, the traffic signal is apparently
malfunctioning, and no motor vehicle or person is approaching or
is so far away that it does not constitute an immediate hazard.

FISCAL NOTE:  No impact on state funds in FY 2010, FY 2011, and
FY 2012.

PROPONENTS:  Supporters say that the bill provides an affirmative
defense for a motorcycle operator in certain situations involving
running a red traffic light.

Testifying for the bill was Representative Jones (117) for
Senator Stouffer.

OPPONENTS:  There was no opposition voiced to the committee.
